Close Family Adoption
A close relative adoption involves the adoption of a child by a grandparent, great-grandparent, aunt or uncle, great-aunt or great-uncle, adult brother or sister, or adult nephew or niece. These adoptions normally proceed quickly through the court unless an interlocutory order and probationary period is required.
In cases where the child has resided in the petitioner’s home for less than three years, a home study must be approved by the juvenile and domestic relations district court prior to filing a petition for adoption in the circuit court. Once the adoption is filed in the circuit court, no further investigation is necessary unless required by the judge.
In cases where the child has resided in the petitioner’s home for more than three years, a home study is not required and the case may be filed directly in the circuit court. No investigation is necessary unless required by the judge.
