International Adoption
- Re-Adoptions – It is recommended that a child adopted in a foreign country by a US citizen and brought to Virginia is “re-adopted” in the United States. This is often necessary to ensure the child becomes a United States citizen, to obtain a state issued birth certificate, to obtain a court ordered name change and/or to ensure the validity of the foreign adoption decree for inheritance purposes. The adoptive parents will need to provide all the necessary documents from the foreign country with certified translations.
- Intercountry Relative Adoptions – The process involved in this type of adoption will depend on whether the child’s country of origin is a Hague Adoption Convention country. In either case, pre-approval is required for intercountry placement unless the final order of adoption was obtained in the foreign country.
- Placement by Foreign Agency or Court – If an agency doption was not finalized in the foreign country, it can be finalized in the United States. Certified translations of all documents placing the child with the adoptive parents is required prior to filing the adoption petition. Post placement visits and an investigative report will need to be completed by DSS or the agency that performed the initial home study.
