Parental Placement Adoptions
In cases where the birth parents directly place their child with the adoptive parents, the first hearing is held in the juvenile and domestic relations court to approve the birth parents’ consent, terminate their parental rights and transfer custody to the adoptive parents. A home study is required of the adoptive parents’ home prior to this initial hearing. Following that, the petition for adoption can be filed in the circuit court where an investigation and report will ultimately be prepared and filed with the court by the same agency that prepared the home study. This can be a lengthy process but a circuit court appearance is typically not necessary.
